 Don't go into the Foreclosure Process Blindly!

 

Be Aware of Options For Stopping Foreclosure

1. Short Sale

 

A short sale is when your lender agrees to allow the property to be sold for less than you owe on it.  It has become the most common way to stop foreclosure of your home.  There are GREAT advantages to doing a short sale on your home verses letting it go into foreclsoure.  Among the few are you continue to live in the home as it is put on the market for sale.  There is less impact to your credit report in most cases.  Laws now protect you from the lender pursuing the loan deficiency.  Lenders are now allowing homeowners to purchase homes within a coule of years of a short sale.

In most cases the short sale process begins immediately and stops your home from going to foreclosure.  

In cases where it is just a few days away from foreclosure the lender is likely to not allow a short sale because they have paid the fees to have the foreclosure done.

 2. Loan Modification

Loan modifications have become available through a government  intervention to motivate lenders to restructure debt when the homeowner can make the home payments but is just behind.  These are most common in situations where a borrower may have lost a job or had other financial circumstances that kept them from paying the payments but now they are able to make the payments due to re-employment or change in their financial circumstances.  The highest benefit for this program is that the homeowner will continue to own the home and the payments are reduced.

 3. Note Purchase

A note purchase is not common but in many cases is the best option for a homeowner.  We have a team of investors that will purchase your defaulted note from the bank.  The note is purchased by the note buyer.  In many cases the note buyers do a "mortgage makeover" and you continue to live in and own the home.  If the mortgage "mortgage makeover" is not an option then a note purchase can still be an option when you agree to transfer ownership of the home to the note buyer.   This stops the foreclosure and keeps a short sale and foreclosure from the homeowners credit.  Not all homes will qualify for this program but most do.  Please note:    NEVER agree to deed your home directly to someone.  This type of transaction is always best when closed through a title company so that you are protected from predators who prey on challenged homeowners.  

The highest benefit when your note is purchased is the bad debt goes away and your credit is spared the more severe negative reporting of a foreclosure.  Your credit will repair more quickly which will allow for you to buy another home in a shorter term.

This option is the most beneficial for the homeowner.  Very few people even know that it exists, including many REALTORS®.

 4. Do Nothing

This is the worst option for a homeowner.  When you do nothing you are destined to foreclosure.  You have options!
